TERMS AND CONDITIONS Rental Period and Pricing Reservations should be made well in advance of your event to assure availability; all rentals are on a first come first serve basis. We suggest the site be inspected and measured before a contract is written. All rentals require a 50% non-refundable deposit to confirm the reservation and hold the rental items. The contract amount is subject to sales tax unless a tax-exempt form is presented by the customer by the time of final payment. Rental rates on most equipment are for 1-day events, orders for weekends or periods that are longer than 2-3 days are available by quote and must be specified in the rental contract. Charges are based on time out, whether the items are used or not. Prices are subject to change without notice and do not include tax or damage waiver. Inspection Customer acknowledges that Customer has had an opportunity to personally inspect the equipment, and finds it suitable for the Customer’s needs; the equipment is in good working order and Customer understands its proper use. Customer will advise the delivery and/or setup team or head office (631-961-4094) of any defects prior to team leaving event location. Replacement of Malfunctioning Equipment If the equipment becomes unsafe or in disrepair as a result of normal use, Customer agrees to discontinue use and notify the head office (631-961-4094), the head office will be given the opportunity to substitute the equipment with a similar, in good working order replacement, if available/ feasible. Weather Customer understands that tents are temporary structures designed to provide limited protection from weather conditions. Tents are not guaranteed to be completely waterproof, and even with the required tent heaters, are usually only able to achieve an increase of 20 degrees above the outside temperature. Customer also is aware that, there may be situations that become unsafe such as high winds or lightning. Evacuation of tents is recommended in these or other unsafe conditions. TT&A Tents & Events reserves the right to disassemble and/or retrieve our equipment if weather conditions pose a risk of safety to any individual or damage to our equipment. Heaters and Tent Sides Heaters and tent sides must be paid in full to confirm reservation; and once reserved there are no refunds on these items. Tent sides and tent heaters are limited supply items, and once reserved they are immediately pulled from our inventory for customer’s required dates. In order to provide dependable, and high-quality service to our customers at the best prices, we are unable to offer any refund on these two items. Delivery and Set Up We deliver to most locations; charges vary, and are based on the distance from our location in West Babylon, New York. Standard delivery and pickup include drop off to first floor or ground level dock or curb during our regular business hours (Monday-Friday 9:00AM-5:00PM), additional charges apply for off hours delivery/ pickup. Multiple pickup and or drop-off sites may also incur additional fees. Items must be stacked or repacked in the original delivery containers and location for pickup. Set up and knock down of rentals items excluding tents is not included in our standard rental or delivery fee. That service is available at a nominal cost if arranged at the time of the reservation. A competent adult, who is either the customer or customer’s designee should be available at the delivery/ setup location to sign off at the completion of the setup but is not necessary. We call the weekend before to arrange delivery times. Delivery can be anywhere from 1-3 days before the event depending on the size and type of event. If the delivery location has certain time constraints, then we are more than willing to work with them for most instances. Feel free to contact us at any time for delivery questions, but understand that if the date is still some time away, we will only be able to give you an estimated delivery day. Underground facilities and Site Preparation Tents are often secured to the ground by driving metal stakes up to 42 inches long into the ground. Customer agrees to have all underground facilities including but not limited to, sprinkler systems, phone, electrical, gas, water lines and septic systems clearly marked prior to the arrival of the delivery and setup crews. Customer assumes full responsibility for damage to all underground facilities and any injury or death resulting from facilities not clearly marked. If we are contracted/ required to deliver any equipment, customer agrees to have the site, clean, clear and ready for delivery and installation, dismantling or retrieval of rental equipment (i.e. lawns mowed, furniture/ debris moved, pet droppings picked up, tree branches that could be hazardous to the tent removed). We are not authorized to touch or move anything that could be in the way. If the clearing of the area takes more than 10 minutes. There will be a $10 charge for every 10 minutes after the first 10 minutes. Access to Dealer Equipment TT&A Tents and Events has the unobstructed right to enter any property and gain access at any reasonable time, for maintenance, service and to check for proper securement, security and safety of our rented equipment. Cancellations When customers reserve a tent, equipment or any accessory, we immediately remove them from our inventory and schedule a crew. Therefore, initial deposits are non-refundable and all customer cancellations must adhere to our cancellations policy as per our contract. Tent Packages Tent packages are structured to provide our customers with the best prices possible, while also providing top notch, dependable service. As such, packages are fixed, there are no substitutions or adjustments. Hold Harmless Customer agrees to, and shall indemnify and hold Tabtifal LLC dba TT&A Tents and Events, harmless from all claims, losses, damages, cause of actions, suits and liability of any kind, including all expenses of court costs, litigation fees, attorney’s fees, for injury to or death of any person, or damage to any kind of property, or for any breach of contract, arising out of or in connection with this rental agreement and purpose for which this rental agreement was entered into, including but not limited to property damages, injuries and death due to the act, omission, mistake, fault, default or negligence of the customer, its agents and employees, any invitees, any uninvited guests, licensees, guest by invitees of the customer. Any customer, who enters into a contract with Tabtifal LLC dba TT&A Tents and Events, agrees to have a confirmed and valid credit card on records with Tabtifal LLC at all times during the rental period. You hereby authorize Tabtifal LLC to store your card information and to charge all sums due to Tabtifal LLC at any time during the term of this agreement, including damages, unreturned items, extra delivery fees and rental fees for items not returned by the due date. Day of the Event 1) Please have all tent locations cleared and properly marked prior to the delivery team’s arrival, this will make the setup move smoothly and efficiently. You can use paint, chalk, sticks in the ground or any other small furniture to mark the tent corners. 2) If tent sidewalls were reserved, our crew will install them, folded up or extended down depending on your demands. However, once they are installed, do not remove them from the tent. Our crew will show you how to extend them down if they were folded up, without soiling or causing damage to the equipment. 3) Tables and chairs are not set up by our crew; unless a diagram was submitted and approved at least a month prior to the event. Tables will be set up under the tent with chairs stacked neatly on top of them. This is also the manner in which they should be staged for pickup, to avoid a breakdown fee. 4) TT&A tents will not set up pole tents on any surface if it cannot be staked into the ground, no exceptions. If you require a tent without staking, please reserve a frame tent, that can be secured to the ground using weights for a nominal charge. 5) Frame and pole tent legs may scratch and cause minor damage to the surfaces they are set on. Stakes may also cause minor damage to lawns and other surfaces as well. Customer understands this and holds Tabtifal LLC dba TT&A Tents and Events, harmless from all claims resulting from any such damage. 6) No items will be attached to our equipment using tacks, pins, staples or any items that may soil or cause damage. The only exception being for tape on the underside of tables. At no time should tape be put on the vinyl of tents. There may be a cleaning or repair charge for any damage resulting from attaching any item to our equipment. 7) All trash and decorations of any kind should be removed from the tent or any equipment after your event. There will be an additional charge for extra cleaning or damage from decorations. Summary: Responsibility of the equipment remains with the customer from the time of delivery to the time of pickup. All collection fees, court costs, or any expense involved in the collection of rental charges will be the customers responsibility.
